G & M Equipment Rentals - Terms and Conditions

1. Rental Agreement

By renting equipment from G & M Equipment Rentals ("Company"), you ("Customer") agree to all terms and conditions outlined in this document. These terms constitute a legally binding agreement between Customer and Company.

1.1 Rental Period

  • The rental period begins when equipment leaves our facility or is delivered to Customer
  • Rental period ends when equipment is returned to our facility or picked up by our staff
  • Minimum rental period is 24 hours (1 day) unless otherwise specified
  • Equipment returned early will be charged for the full reserved period

1.2 Identification and Payment

  • Valid government-issued photo ID required for all rentals
  • Credit card or debit card required for security deposit and payment
  • Cash payments accepted only for pre-approved customers with established history
  • Security deposit required for all equipment rentals (amount varies by equipment)

2. Equipment Care and Operation

2.1 Customer Responsibilities

  • Operate equipment in accordance with all provided instructions
  • Use equipment only for its intended purpose
  • Restrict operation to qualified individuals over 18 years of age
  • Keep equipment in a secure location when not in use
  • Return equipment clean and in the same condition as received
  • Report any operational issues or damage immediately

2.2 Prohibited Actions

  • No use of equipment by persons under the influence of alcohol or drugs
  • No removal of safety guards or disabling of safety features
  • No unauthorized repairs or modifications
  • No subletting or loaning of equipment to third parties
  • No use of equipment beyond its rated capacity

3. Fees and Charges

3.1 Rental Rates

  • Daily, weekend, and weekly rates available as specified in rental agreement
  • Overtime charges apply for equipment returned after agreed return time
  • Additional charges apply for excessive wear or cleaning requirements

3.2 Damage and Loss

  • Customer assumes full responsibility for any damage to equipment
  • Repair costs will be charged at prevailing rates for parts and labor
  • Full replacement value charged for equipment damaged beyond repair
  • Theft or loss of equipment is Customer's responsibility and will be charged at full replacement value

4. Delivery and Pickup

4.1 Delivery Services

  • Delivery fees based on distance from our facility
  • Customer must provide clear access to delivery location
  • Customer or authorized representative must be present to accept delivery
  • Additional fees apply if delivery personnel must wait more than 15 minutes
  • Specific placement instructions must be provided at time of reservation

4.2 Pickup Services

  • Equipment must be accessible for pickup at agreed time
  • Additional fees apply if equipment is not ready or accessible
  • Customer remains responsible until equipment is in Company possession
  • Confirmation of pickup does not constitute acceptance of condition

5. Cancellation Policy

  • Cancellations more than 48 hours before rental: full refund minus $25 processing fee
  • Cancellations 24-48 hours before rental: 50% of rental fee forfeited
  • Cancellations less than 24 hours before rental: No refund
  • Reservations modified more than 24 hours in advance: No penalty if equipment is available

6. Liability and Insurance

6.1 Assumption of Risk

  • Customer assumes all risk associated with possession, operation, and use of equipment
  • Customer acknowledges equipment operation can be dangerous and involves risk
  • Customer is responsible for providing proper safety equipment and training for all operators

6.2 Indemnification

  • Customer agrees to indemnify and hold Company harmless from any claims, actions, damages, liabilities, and expenses arising from use of equipment
  • This includes attorney fees and costs of defense for any claim or action

6.3 Insurance

  • Customer must maintain appropriate insurance coverage
  • Commercial customers must provide proof of general liability insurance
  • Personal injury and property damage are Customer's sole responsibility

7. Miscellaneous Provisions

7.1 Governing Law

  • This agreement shall be governed by the laws of the State of Michigan
  • Any disputes shall be resolved in courts located in Iosco County, Michigan

7.2 Severability

  • If any provision of this agreement is found invalid or unenforceable, remaining provisions remain in effect

7.3 Entire Agreement

  • This document constitutes the entire agreement between parties
  • No modifications are valid unless in writing and signed by both parties
